1. Agreement to Terms

By accessing and using MoonWise ("App"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms, please do not use the App.

2. License Grant

2.1 Use License

Permission is granted to download and use one copy of MoonWise for personal, non-commercial use only. This is the grant of a license, not a transfer of title, and under this license you may not:

  • Modify or copy the App materials
  • Use the materials for any commercial purpose or for any public display
  • Attempt to reverse engineer any software contained in MoonWise
  • Remove any copyright or other proprietary notations from the materials
  • Transfer the materials to another person or "mirror" the materials on any other server

2.2 Restrictions

You agree NOT to:

  • Use the App in any way that violates applicable laws or regulations
  • Interfere with or disrupt the App or servers
  • Use any automated means to access the App
  • Attempt to gain unauthorized access to the App or related systems
  • Impersonate any person or entity

3. Intellectual Property Rights

3.1 Our Property

The App and all its content, features, and functionality are owned by MoonWise/Maxnxi and are protected by copyright, trademark, and other intellectual property laws.

3.2 Trademarks

"MoonWise" and related logos are trademarks of Maxnxi. You may not use these trademarks without our prior written permission.

3.3 Feedback

If you provide feedback, suggestions, or ideas about the App, you grant us the right to use such feedback without any obligation to you.

4. User Content and Data

4.1 Your Data

You retain ownership of any data you input into the App, including:

  • Personal information and preferences
  • Location data
  • Notes and observations
  • Custom settings

4.2 Data Usage

By using the App, you grant us a license to store and process your data solely for the purpose of providing the App's features as described in our Privacy Policy.

5. Astronomical Information

5.1 Accuracy Disclaimer

While we strive to provide accurate astronomical and astrological information, we do not guarantee:

  • 100% accuracy of moon phase calculations
  • Accuracy of void of course moon predictions
  • Accuracy of astrological interpretations
  • That the information will be uninterrupted or error-free

5.2 Data Sources

MoonWise uses moonrise data provided by Apple and other astronomical calculation methods. We rely on these third-party data sources and are not responsible for inaccuracies in the source data.

5.3 Not Professional Advice

The information provided by MoonWise is for educational and entertainment purposes only. It should not be considered as:

  • Professional astrological advice
  • Medical, legal, or financial advice
  • A substitute for professional consultation

6. Subscriptions and Payments

6.1 Free and Premium Features

MoonWise may offer both free and premium features. Premium features may require a subscription or in-app purchase.

6.2 Subscription Terms

If you purchase a subscription:

  • You agree to pay the applicable fees
  • Subscriptions automatically renew unless cancelled
  • You can manage subscriptions through your device's account settings
  • Cancellations take effect at the end of the current billing period

6.3 Refunds

Refunds are handled according to the policies of the App Store through which you made your purchase (Apple App Store). We do not directly process refunds.

7. Disclaimers and Limitations of Liability

7.1 "As Is" Basis

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

7.2 No Warranty

We do not warrant that:

  • The App will be uninterrupted, secure, or error-free
  • Defects will be corrected
  • The App is free from viruses or harmful components
  • Results from using the App will meet your expectations

7.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MOONWISE OR MAXNXI BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

7.4 Maximum Liability

Our total liability to you for all claims arising from your use of the App shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or $100, whichever is greater.

8. Third-Party Services

8.1 Third-Party Providers

The App integrates with third-party services, including:

  • Apple Services for moonrise data
  • Analytics providers
  • Calendar system data providers

8.2 Third-Party Terms

Your use of these third-party services is subject to their respective terms and policies. We are not responsible for third-party services or their content.

9. Prohibited Uses

You may not use our App:

  • For any unlawful purpose or to solicit others to perform unlawful acts
  • To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
  • To infringe upon or violate our intellectual property rights or the intellectual property rights of others
  • To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
  • To submit false or misleading information
  • To upload or transmit viruses or any other type of malicious code
  • To spam, phish, pharm, pretext, spider, crawl, or scrape
  • For any obscene or immoral purpose
  • To interfere with or circumvent the security features of the App

10. User Accounts

If you create an account with us:

  • You must provide information that is accurate, complete, and current at all times
  • You are responsible for safeguarding your password
  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorized use of your account

11. Termination

11.1 Termination by You

You may stop using the App at any time by uninstalling it from your device.

11.2 Termination by Us

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for:

  • Violation of these Terms
  • Fraudulent, abusive, or illegal activity
  • Any other reason at our sole discretion

11.3 Effect of Termination

Upon termination, your right to use the App will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive.

12. Changes to the App

We reserve the right to:

  • Modify, suspend, or discontinue any feature of the App
  • Change pricing for subscriptions or in-app purchases
  • Update the App to improve functionality or security

We will make reasonable efforts to notify you of significant changes, but we are not obligated to do so.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by:

  • Posting the updated Terms in the App and on our website
  • Updating the "Last Updated" date
  • Sending you a notification for significant changes

Your continued use of the App after changes become effective constitutes your acceptance of the updated Terms.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Maxnxi operates, without regard to conflict of law principles.

14.2 Dispute Resolution

Any dispute arising from these Terms or your use of the App shall be resolved through:

  1. Good faith negotiations between the parties
  2. Mediation, if negotiations fail
  3. Binding arbitration or court proceedings, as a last resort

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MoonWise/Maxnxi regarding the App.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
